The lawsuit challenges the Texas Volunteer Deputy Registrar statute, which requires individuals that handle completed voter registration applications to be appointed as deputy registrars by the elected County Registrar and subjects them to onerous restrictions and criminal liability. Restrictions challenged include: the prohibition on terminating a canvasser if the termination is based on the canvassers inability to collect applications from individuals interested in registering to vote; canvassers having to be eligible to register to vote in Texas; a prohibition on collecting an application from an individual who does not reside in the county where the canvasser is a deputy registrar; training requirements with no mandate that the County conduct training; requirements that applications must be personally delivered, not mailed; and the ability of Registrars to reject incomplete applications and terminate a deputy’s appoint for not making sure the applications are complete.  The Defendants have filed for a motion to dismiss.
